there r 2 commercial property in my mother's name. 1st shop earns 36500.00 pm rent & other will start earning 50000.00 pm rent. So total would be 86500.00 pm and 1038000.00 per annum making my mother liable to highest incoem tax bracket and service tax.Queries1 Can my mother gift one of the property to my wife House wife, no income so that income distributes to save on income tax2 If yes what would be the process3 what would be the gift tax stamp duty or any other charges involved4 If property is transferrable, then is it possible to get into the agreement with tenant before transferring property from mother to daughter in law only on the basis of Authority letter as the tenant may not wait for the time taken to transfer4 And also i ve heard that even though the property would be gifted to daughter in law , the income arising out of that property would be taken as the income of mother, Is it so and if yes is there any work around it5 when is service tax applicable on rental income. is it 8 lac or 12 lac per annumWould highly appreciate and early responseThanx

Whats the process for letting commercial property?
Please bear with me because i'm new to all this I am looking at opening a Sushi takeaway and have been looking at suitable commercial premises. However it seems to be quite confusing regarding the leasing agreements. Firstly there seems to be a massive price difference between premises. For example I've seen 2 shops within 100m of each other with very little size difference and one is twice the price of the other?As far as I can work out if the lease is still running then you just pay the rent which is set at X ammount per annum at the agreed rate. What would happen if you decided to close down after a year but the lease runs for another 5 years? Is there usually a charge?I've noticed that on quite a few adverts you will get something like this " Leasehold The lease expires 11 October 2021. Our clients are looking for a premium of 25,000 for their leasehold interest." Does this mean that you will have to pay 25,000 just to renew the lease? If so then why is this?Any help would be greatly appreciated.Thanks
