Can I sue a seller or listing agent for home inspection or appraisal fees?
We found a home to buy, entered into a contract to buy it, obtained a home inspection and a required from my mortgage company appraisal and found out just days before closing that there were four years of back taxes on the property. The seller refuses to leave money in escrow to cover these taxes for more than 30 days even though the county district stated that it would take longer than that to assess the taxes and generate the bill. Had we known about this, we wouldn't have sunk hundreds of dollars into these inspections and appraisals. Can we sue for these fees from the seller or listing agent in a small claims court for not disclosing this information upfront? Or is this just one of those unfortunate things in the process of home buying?
